Theory Orbit ("Theory Orbit," "we," "us," or "our") respects your privacy and is committed to protecting it through our compliance with this Privacy Policy ("Policy"). This Policy describes the types of information we may collect from you or that you may provide when you visit theoryorbit.com (the "Site"), contact us by phone or email, submit an inquiry form, or otherwise interact with our services (the "Services"), and our practices for collecting, using, maintaining, protecting, and disclosing that information. By accessing or using the Site or Services, you agree to this Policy. If you do not agree, do not access or use the Site or Services.

Information We Collect

We collect several types of information from and about users of our Site and Services, including information:

  • Personal Information by which you may be personally identified, such as your name, company, postal address, email address, telephone number, job title, and any other identifier by which you may be contacted online or offline.
  • Inquiry Content — the contents of any message, request, project brief, or attachment you submit through our contact form, by email, by SMS, or by phone.
  • Commercial Information about engagements, proposals, invoices, and correspondence history.
  • Technical Information about your internet connection, the equipment you use to access the Site, IP address, browser type and version, operating system, device identifiers, referring URLs, pages viewed, and timestamps.
  • Usage Details about your visits, including traffic data, logs, and other communication data and the resources you access and use on the Site.

We collect this information (a) directly from you when you provide it to us; (b) automatically as you navigate through the Site (information collected automatically may include usage details, IP addresses, and information collected through cookies and similar technologies); and (c) from third parties, for example, our business partners, hosting providers, and email providers.

How We Use Your Information

We use information that we collect about you or that you provide to us, including any Personal Information:

  • To present the Site and its contents to you.
  • To respond to your inquiries, provide requested information, deliver proposals, and administer engagements.
  • To communicate with you about your account, our Services, changes to our terms or policies, and other administrative messages.
  • To send you information via phone call, SMS/text message, or email that you have consented to receive, including updates, follow-ups, appointment reminders, and information about our Services.
  • To operate, maintain, secure, and improve the Site and Services, including analytics and troubleshooting.
  • To detect, prevent, investigate, and address fraud, unauthorized or illegal activity, and violations of our Terms of Service.
  • To comply with our legal and regulatory obligations.
  • For any other purpose disclosed by us when you provide the information or with your consent.

Disclosure of Your Information

We do not sell your Personal Information. We may disclose Personal Information that we collect or that you provide as described in this Policy:

  • To our affiliates, subsidiaries, and personnel.
  • To contractors, service providers, and other third parties we use to support our business (e.g., hosting, email delivery, analytics, CRM, and telephony/SMS providers) and who are bound by contractual obligations to keep Personal Information confidential and use it only for the purposes for which we disclose it.
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Theory Orbit's assets.
  • To fulfill the purpose for which you provide it.
  • With your consent.
  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
  • To enforce or apply our Terms of Service and other agreements.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Theory Orbit, our clients, or others.

We do not share, sell, rent, or transfer any mobile telephone numbers or SMS opt-in data with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors or service providers who support the delivery of our SMS messaging program (for example, our telephony provider) is permitted; all other categories of information sharing exclude mobile opt-in data.

TCPA Consent

By providing your telephone number to Theory Orbit — including through our contact form, email, or verbally — and by opting in to receive communications from us, you expressly consent under the Telephone Consumer Protection Act ("TCPA"), 47 U.S.C. § 227, and its implementing regulations, to receive telephone calls and SMS/ text messages from Theory Orbit and its authorized agents at the telephone number you provided, including calls and messages delivered using an automatic telephone dialing system, an artificial or prerecorded voice, or automated technology. You understand and agree that:

  • Consent is not required as a condition of purchasing any goods or services.
  • Message and data rates may apply, and message frequency will vary.
  • You represent that you are the subscriber of, or a customary user authorized to consent for, the telephone number you provide.
  • You may revoke your consent at any time as described in the SMS Terms below and by replying STOP to any text message from us.

SMS Terms and Conditions

The following terms apply to the Theory Orbit SMS/text messaging program:

  • Program description. We send transactional and informational messages related to your inquiry or engagement, including responses to requests, scheduling, follow-ups, and program updates.
  • Message frequency. Message frequency varies based on your interactions with us.
  • Cost. Message and data rates may apply. Check your mobile plan for details.
  • Opt-in. You consent to receive messages by providing your mobile number and affirmatively opting in (for example, by checking a consent box, replying to confirm, or providing verbal consent).
  • Opt-out (STOP). You may cancel at any time by texting STOP to the number from which you received messages. After you send STOP, we will send you a message confirming your unsubscription. After confirmation, you will no longer receive messages from us. To rejoin, sign up as you did the first time.
  • Help (HELP). Text HELP to the number from which you received messages for assistance, or contact us at 516.418.8148 or info@theoryorbit.com.
  • Carriers. Supported carriers include, but are not limited to, AT&T, T-Mobile, Verizon Wireless, Sprint, and Boost. Carriers are not liable for delayed or undelivered messages.
  • Privacy. Your mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. See "Disclosure of Your Information" above.

Cookies and Tracking Technologies

The Site uses cookies and similar tracking technologies to distinguish you from other users, remember your preferences, and understand how the Site is used. A cookie is a small file placed on your device. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, some parts of the Site may become inaccessible or not function properly. We do not currently respond to Do Not Track signals.

Data Security

We have implemented commercially reasonable administrative, technical, and physical safeguards designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration, and disclosure. Measures include encryption of data in transit using TLS, access controls, least-privilege permissions, and regular review of our security practices.

The safety and security of your information also depends on you. Where you have chosen credentials for access to certain parts of our Services, you are responsible for keeping those credentials confidential. We ask you not to share your credentials with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of information transmitted to the Site or Services. Any transmission of Personal Information is at your own risk.

Data Retention

We retain Personal Information for as long as necessary to fulfill the purposes for which it was collected, including for the purposes of satisfying any legal, accounting, or reporting requirements, and to resolve disputes and enforce our agreements. Inquiry correspondence is typically retained for up to twenty-four (24) months from last contact. Server log data is retained on a short rolling basis for security and operational purposes. You may request deletion of your information as described in "Your Choices and Rights" below.

Minors

The Site and Services are not directed to children under the age of sixteen (16). We do not knowingly collect Personal Information from children under 16. If we learn we have collected or received Personal Information from a child under 16 without verification of parental consent, we will delete that information. Your Choices and Rights

You may:

  • Access, review, correct, or request deletion of the Personal Information we hold about you by contacting us.
  • Opt out of promotional emails at any time by following the unsubscribe instructions in any email we send you.
  • Opt out of SMS messaging by replying STOP as described in the SMS Terms above.
  • Ask us to stop calling you by telling us during a call or by contacting us at 516.418.8148 or info@theoryorbit.com.

California Privacy Rights

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the "CCPA"), provides you with specific rights regarding your Personal Information. This section describes those rights and explains how to exercise them.

Categories of Personal Information collected. In the preceding twelve (12) months, we have collected the following categories of Personal Information: identifiers (e.g., name, email, phone, IP address); commercial information (e.g., engagement history); internet or other electronic network activity information (e.g., browsing information on the Site); professional or employment-related information (e.g., company, job title); and inferences drawn from the above.

Sources. We collect this information directly from you, automatically from your device when you interact with our Site, and from service providers.

Business purposes for collection. We use this information for the purposes described in "How We Use Your Information."

Disclosure. We disclose the categories above to the categories of recipients described in "Disclosure of Your Information." We do not sell or share (as those terms are defined in the CCPA) Personal Information, and we have not done so in the preceding 12 months. We do not use or disclose sensitive Personal Information for purposes that would require offering a right to limit under the CCPA.

Your California rights. Subject to certain exceptions, you have the right to: (a) know the categories and specific pieces of Personal Information we have collected about you; (b) request deletion of Personal Information we have collected from you; (c) request correction of inaccurate Personal Information; (d) opt out of the sale or sharing of Personal Information (not applicable, as we do not sell or share); (e) limit the use of sensitive Personal Information (not applicable, as we do not use it for purposes that trigger this right); and (f) not receive discriminatory treatment for exercising any of your CCPA rights.

How to exercise. To exercise any of these rights, submit a verifiable request by emailing info@theoryorbit.com or calling 516.418.8148. We will need to verify your identity before responding, which may include matching information you provide against information we maintain about you. You may use an authorized agent to submit a request on your behalf; we will require written authorization and may require the agent to verify their own identity.

Response timing. We will confirm receipt of your request within ten (10) business days and respond substantively within forty-five (45) days, subject to one 45-day extension where reasonably necessary and permitted by law.

Shine the Light (Cal. Civ. Code § 1798.83). California residents may request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. We do not disclose Personal Information to third parties for their direct marketing purposes.

Changes to Our Privacy Policy

We may update this Policy from time to time. If we make material changes, we will notify you by revising the "Last updated" date at the top of this Policy and, where appropriate, by providing additional notice. Your continued use of the Site or Services after the effective date constitutes your acceptance of the revised Policy.
